Buying a defective product is always an annoyance. It fails to work as advertised, you feel ripped off and you waste both time and money taking it back to the store and exchanging it. Depending on the situation, there are two types of compensation or reimbursement you may be entitled to.

If you’re not hurt, you usually still have the right to get the money back for the defective item. Most often, the store or the manufacturer will refund your money. In some cases, you need to cite the warranty and send the product in to be compensated. In either case, you’re just going to get back what you had into it — the cost of the item.

If you are hurt, that’s when things change. You still can seek reimbursement for the price of the item, but it may be the least of your worries. You could also be looking at medical bills, rehab costs and other such things that go along with your injury. On top of that, the company’s mistake caused you to experience unfair pain and suffering and emotional stress, and you may be able to get compensation for that, as well.

Basically, you are looking at more than just the defective product itself; you’re looking at how that defective product changed your life. Did it cause you disfigurement? Does it mean you can’t work anymore? These are important questions to ask.

As you can see, it’s quite important to know about all of your legal options in Illinois when you buy a defective product, especially when you or a loved one are hurt as a result.
