Why Are Permanent Disability Benefits Necessary?

After you have reached what doctors consider to be maximum medical improvement (MMI), the point at which doctors do not expect you to improve beyond your recovery so far, your employer and the Illinois Workers’ Compensation Commission will begin the process of assessing permanent disability benefits. There are four basic types of permanent disability benefits, including:

  • Wage differential. If your injuries force you to take a lower-paying job, this will pay two-thirds of the difference between the amount you earn at a new job in the amount you previously earned at a higher paying job.
  • Scheduled injury. Depending on the body part that is permanently injured, you may be able to collect weekly disability payments for 60% of your average weekly wage for a specific number of weeks allotted to that body part.
  • Percentage of loss of a person as a whole. For instances in which your injuries caused permanent limitations to the use of your body, you may be able to recover 60% of your average weekly wage for up a specific amount of week based on the severity of your disability.
  • Disfigurement. If you have suffered a serious or permanent change to your appearance (for certain parts of your body), you may be entitled up to 162 weeks of 60% of your average weekly wage.
